Texas 2021 Stormwater Multi-Sector General Permit (MSGP) Renewal

The new Texas Pollutant Discharge Elimination System (TPDES) Stormwater Multi-Sector General Permit (MSGP), TXR050000, becomes effective August 14, 2021. Is your facility ready? The MSGP authorizes the discharge of stormwater into, or adjacent to, waters in the state from industrial facilities based on Industrial Activity codes and primary SIC codes. The Texas Commission of Environmental Quality (TCEQ) incorporated comments from both industry and environmental groups into the MSGP and additional guidance can be found on the TCEQ stormwater permitting webpage.


We’ve summarized permitting basics in our Texas MSGP Brochure and listed KEY actions & changes below:


Action Items: Existing permittees have 90 days (until November 12th) to renew their permit authorization.

  1. Submit a renewal Notice of Intent (NOI) or No Exposure Certification (NEC), as applicable, using TCEQ’s online e-permitting system STEERS, and

  2. Update and implement your Stormwater Pollution Prevention Plan (SWP3).


Summary of Changes:

  1. The Delegation of Signatory, NOI/NEC, and NOC forms must be submitted electronically via STEERS;

  2. Discharge Monitoring Reports (DMRs) must be submitted electronically via NetDMR;

  3. Lower benchmark values for Sector T (Treatment Works) and Sector U (Food and Kindred Products Facilities); and

  4. New BMP’s for facilities handling pre-production plastic to address plastic materials in stormwater discharges.
